We are looking for an ethical hacker to assist our fight against Chinese counterfeiters. Objective: - We have specific targets in mind that are described below. Reporting: - After the ethical hacking process, we would need a basic summary of accomplishments. SUMMARY: • Chinese counterfeit ring targeting small, family-owned business • We own an extensive US utility patent, US registered trademarks, and US copyright • Patents pending in Canada and EU • Over 1100 separate sellers and listings offering counterfeits on major marketplaces • We use [login to view URL] service to identify and remove counterfeit sellers on marketplaces • Have found over 40 independent sites also selling the counterfeits • All infringing sites have registrant info hidden via proxy services • Large ad budget—have found ads on CNN, Google, Bing, major newspapers, etc. • Have located manufacturer in China, but not the organization behind it We are a small US business with a patented product which has been counterfeited by a criminal group in China. We have identified over 1,100 separate sellers on Amazon, eBay, Walmart, ETSY, Facebook, and all the various Alibaba websites—all since April 2023. Our sales plummeted 95% during the height of the counterfeit attack over the summer. We have identified the source manufacturing the counterfeits inside China (via Alibaba), but not the criminal ring with the deep pockets behind it all. The reason we suspect organized crime is that in addition to the individual listings in the marketplaces above, there are also around 40 independent websites selling the counterfeits. These sites have purchased ads on Google, CNN, Bing, and a large number of major US newspapers, all of which, of course, point to a single organization with enough cash to purchase these costly ads. All the independent sites protect the registrant's identity via proxy registration services, so we have been unable to identity who owns all these sites. We suspect this is a single entity, as they all use the same photos and videos stolen from our sites. We have naively done all the things you are supposed to do to protect our IP, and it has done nothing to help us. We have hired attorneys with experience with Chinese counterfeiters and it has turned into a slow, expensive process with nothing to show for it at this time. We are extremely frustrated. We feel like the entire legal process is stacked against small entrepreneurs like ourselves. Therefore, I would like an expert to do several things for us: 1. Bypass all the domain proxy protections and extract the registrants and all their contact detail for the independent websites. Are they all in China or do they have any US addresses against whom we could pursue legal claims? Perhaps all 40 may not need to be identified if the first few are all the same, or similar enough that our suspicions of common origin is proven. 2. Google, Bing, CNN etc. will occasionally remove infringing content after we have gone through the painstaking process of reporting infringing content, but they will not reveal who purchased the ads without a court subpoena, and we cannot even file a lawsuit because we don’t even know who is behind this—the old chicken and egg dilemma. We need you to find out who is paying for all the ads. Are these the same as the domain registrants or are they using US-based digital agencies who we can prosecute (i.e. who are their accomplices)? And is there any way to stop the ads from continuing to run? 3. Shut down all 40+ independent sites selling counterfeits. This may not be as hard as it sounds, because I suspect they are likely the same organization and probably have the same site structure—once one is shut down the others will likely fall quickly. I will supply extensive documentation about this battle, including a list of all the current counterfeit. However, I was wondering if this is even a task that is feasible, and if you have the necessary expertise to do this work, and if so, what type of budget would be needed to perform the work. Thank you. We do not know you. To establish credibility, we will need 3 or more references. Also, we will be divulging confidential information to you. Are you willing to sign a Non-Disclosure Agreement? . Possible followup work if the above is successful: 1. Amazon has permitted hundreds of counterfeit listings since April. This includes a 3+ month period where they allowed hijacking of our legitimate ASINs. The outpouring of hateful 1-star reviews of the counterfeits under our ASINS (because the counterfeit products are so poorly made) were so bad that we were forced to delete the ASINs because Amazon refused to do the right thing and remove the counterfeit reviews. Our new ASINs suffer from lack of legitimacy without a history of high reviews. a. Penetrate Amazon to discover how many counterfeits of our products they permitted these bad actors to sell, at the expense of our legitimate listings. We need this number to be able to establish realistic loss of revenue from Amazon’s failure to police bad actors and protect us as legitimate sellers who own all the IP. 2. Protect our legitimate website, emails and computers from a retaliatory attack from the counterfeiters.
